ENBRIDGE RULING MAKES THE COURTROOM TOUGHER ON INDUSTRY On April 22, 2026, the United States Supreme Court issued a unanimous ruling in Enbridge Energy, LP v. Nessel, a case that carries profound implications for the American hardgoods wholesale distribution sector. While the core of the dispute concerned the operation of the Line 5 pipeline in Michigan, the Court’s decision focused on a critical procedural hurdle: the strict 30-day deadline for “removing” a case from state to federal court. For hardgoods distributors—the backbone of the U.S. supply chain for construction, industrial, and infrastructure materials—the ruling creates a more rigid and potentially restrictive courtroom environment. The Supreme Court held that the 30-day window to move a state-court lawsuit to federal court under 28 U.S.C. § 1446(b)(1) is mandatory and not subject to “equitable tolling.” Enbridge had waited 887 days to remove a lawsuit filed by Michigan Attorney General Dana Nessel, arguing that later legal developments justified the delay. Justice Sonia Sotomayor, writing for the Court, rejected this, stating that the statute’s text and structure do not allow for such extensions. In the past, many relied on the hope that federal jurisdiction might become clearer as a case developed. That safety net is gone. [2] Increased State Court Exposure: Since many environmental and “public nuisance” lawsuits are filed in state courts—which are often perceived as more sympathetic to local plaintiffs—distributors may find themselves trapped in less favorable venues if they miss the narrow removal window. [3] Supply Chain Volatility: The ruling clears the path for Michigan’s state court to potentially order the shutdown of Line 5. For wholesalers, this threatens the supply of propane and refined products used in manufacturing and heating, potentially spiking operational costs and disrupting the availability of petroleum-based hardgoods.
